PERJANJIAN PERKAWINAN TRADISI NIKAH ANGKAP SUKU GAYO ACEH DALAM PERSPEKTIF FILSAFAT HUKUM ISLAM

Abstract


Holding a marriage agreement is one of the persuasive efforts in dealing with family challenges. It is negotiated and made before and during the marriage procession by both parties. According to Indonesian law (Article 29 of Law No.1 of 1974 regarding Decision No.69 of 2015 of the Constitutional and Matrimonial Court), the marriage agreement is signed before and during the marriage, both The parties, by mutual agreement, may sign in writing. The agreement is approved by the marriage registrar. However, the traditional marriage contract of the Gayo tribe in Aceh requires the husband to live in the wife's (matrilineal) residence and the husband will not receive any joint property in case of divorce. Therefore, the author interested in figuring out the problem about how is the marriage agreement trough islamic philosophy lense as an effort to achieve tranquility in family life. The conclusion of this study is that the philosophy of Islamic law, in context of marriage agreements in the Angkap marriage tradition, the ontology and episetimology approaches can be used to examine and consider the certainty and benefits of the agreement. Marriage agreements can provide many benefits for couples in marriage, including maintaining financial balance, disputes prevention, protection providing, risk reduction in divorce, as well as efforts to achieve sakinah mawaddah wa rahmah.
