Identity Politics in the Frame of Maqāṣid Syarī`ah: Realizing Just and Civilized Pluralism in Indonesia
Abstract
Identity politics is a growing phenomenon in democratic country, especially in multicultural societies like Indonesia. On the one side, identity politics can serve as a means to assert the identity of a minority group, or conversely it can be used as a tool to influence society ang gain political support in the name of a particular religion, race, ethnicity or certain groups. This paper aims to examine identity politics within the framework of maqāṣid syarī`ah as an effort to realize just and civilized pluralism. Maqāṣid syarī`ah as the main rule or goal of Islamic law is in harmony with the exist in Indonesia, both religion, ethnicity, race and culture by emphasizing the preservation of religion, soul, mind, descendants and property. This research method uses a qualitative-descriptive research type based on literature studies using an approach through collecting various written sources including Law Number 7 of 2017 concerning Elections and General Election Commission Regulation Number 13 of 2024 concerning the Election Campaign for Governors, Regents and Mayors as primary data sources and secondary data sources sourced from books, articles, journals verses of the Qur’an and official documents related to identity politics. Data analysis techniques are carried out by examining and interpreting the meaning and relationship between ideas in the text to obtain an overview of identity politics. The research result show that identity politics can have a negative impact if the use of identities such as religion, ethnicity, race and culture is used specifically to exclude other groups in politics. This has the potential to ignore national values in accordance with Pancasila, which will impact solidarity and can lead to division. Maqāṣid syarī`ah is a framework in efforts to realize justice and civility towards all differences especially those that emphasize the maintenance and protection of religion, soul and mind with the hope that all identities can be valued, existence respected and responded to with unity and tolerance.
