Retraction & Correction

Retraction & Correction (R & C) Policy

Yurisprudentia: Jurnal Hukum Ekonomi is committed to maintaining the integrity, accuracy, transparency, reliability, and completeness of the scholarly record. The journal recognizes that authors devote considerable intellectual effort to preparing research manuscripts and that scholarly publications undergo editorial evaluation and peer review to ensure academic quality.

Nevertheless, circumstances may arise in which published articles require correction, retraction, removal, or replacement because of substantial errors, ethical concerns, unreliable findings, or legal considerations.

Such actions are undertaken with careful consideration and in accordance with recognized principles of publication ethics to preserve the credibility of the journal and the integrity of its electronic archives.

The journal is committed to ensuring that published research in economic law, Islamic economic law, business law, financial regulation, commercial transactions, and related legal disciplines remains reliable, transparent, and accessible to researchers, legal scholars, practitioners, policymakers, and academic institutions.

The editorial procedures outlined in this policy are informed by the principles and recommendations of the Committee on Publication Ethics (COPE).

1. Retraction

Yurisprudentia: Jurnal Hukum Ekonomi is dedicated to preserving the integrity of the scholarly record. Retraction may be necessary when a published article contains serious ethical violations, fundamental errors, or unreliable findings that significantly undermine the validity of its conclusions.

Articles may be considered for retraction under the following circumstances:

  • Unreliable Findings: Clear evidence that the findings or conclusions are unreliable because of serious methodological errors, inaccurate legal analysis, data fabrication, data falsification, or other significant problems arising from research misconduct or honest error.

  • Redundant or Duplicate Publication: Substantial findings or scholarly content have been previously published elsewhere without appropriate acknowledgment, cross-referencing, permission, or legitimate justification.

  • Plagiarism: The unauthorized appropriation or presentation of another person's ideas, arguments, legal interpretations, research findings, data, or written expressions without appropriate acknowledgment.

  • Inappropriate Authorship: Serious violations involving guest authorship, gift authorship, ghost authorship, unauthorized authorship changes, or misrepresentation of intellectual contributions.

  • Fabrication or Falsification: Deliberate manipulation or invention of research data, legal evidence, judicial decisions, statutory references, interview results, or other materials essential to the validity of the research.

  • Serious Ethical Violations: Significant breaches of research ethics, confidentiality, intellectual property rights, or other ethical requirements that materially affect the reliability or legitimacy of the publication.

  • Compromised Peer Review: Evidence that the manuscript evaluation or peer review process was seriously manipulated or compromised.

Retraction decisions are based on the reliability and integrity of the published scholarly record rather than solely on whether the authors acted intentionally or unintentionally.

Retraction Procedure

To ensure that retraction decisions are handled fairly, transparently, and consistently with recognized publication ethics standards, Yurisprudentia: Jurnal Hukum Ekonomi applies the following procedures:

  1. Identification of Concerns: Potential grounds for retraction may be identified by editors, reviewers, readers, authors, research institutions, or other relevant parties and reported to the journal's editorial office.

  2. Preliminary Assessment: The Editor-in-Chief or designated editor conducts an initial assessment of the reported concerns and determines whether further investigation is warranted.

  3. Investigation and Evidence Review: The editorial team examines available evidence, including the published article, supporting documentation, research materials, correspondence, and other relevant information.

  4. Author Clarification: The corresponding author and, where appropriate, other co-authors are contacted and given a reasonable opportunity to provide explanations, clarifications, or supporting evidence.

  5. Editorial Consultation: When necessary, the Editor-in-Chief may consult members of the Editorial Board, independent experts, relevant institutions, or research ethics specialists.

  6. Editorial Decision: The final decision concerning retraction is made by the Editor-in-Chief or authorized editorial leadership based on the seriousness of the concerns, reliability of the evidence, and applicable publication ethics standards.

  7. Notification of Decision: The editorial office communicates the decision to the authors and, where necessary and appropriate, relevant institutions or other concerned parties.

  8. Publication of Retraction Notice: When retraction is warranted, an official retraction notice is published on the journal website and linked to the original article.

The retraction notice must clearly identify the affected article, explain the reasons for retraction, and indicate which party is responsible for initiating or issuing the retraction.

Where technically possible, the original article will remain accessible in the journal's electronic archive with a clearly visible retraction notice or watermark indicating its retracted status.

The journal will preserve the article's bibliographic information and DOI, where applicable, to maintain the transparency and traceability of the scholarly record.

Retraction does not automatically imply deliberate misconduct by the authors. Articles may also be retracted because of honest errors that substantially undermine the reliability of the published work.

Authors may request retraction of their published articles; however, such requests remain subject to editorial assessment and the journal's responsibility to preserve the integrity of the scholarly record.

The journal follows relevant guidance from the Committee on Publication Ethics (COPE) when handling retraction cases.

2. Article Correction

Yurisprudentia: Jurnal Hukum Ekonomi recognizes that errors may occasionally be identified after an article has been published.

A correction may be issued when the identified error affects the accuracy, clarity, completeness, or interpretation of the publication but does not fundamentally invalidate the article's principal findings or conclusions.

Corrections may be considered under the following circumstances:

  • A limited portion of an otherwise reliable article contains inaccurate information, misleading statements, or errors resulting from an honest mistake.

  • Errors are identified in legal citations, statutory references, judicial decisions, numerical data, tables, figures, or bibliographic information.

  • The author or contributor list contains inaccuracies, including the omission of an eligible author or the inclusion of an individual who does not meet the journal's authorship criteria.

  • Editorial or production errors affect the accuracy, presentation, or scholarly interpretation of the published article.

  • Clarifications are necessary to prevent misunderstanding of legal arguments, research findings, or regulatory interpretations.

Corrections to published peer-reviewed articles may take the following forms.

A. Publisher Correction (Erratum)

An erratum is issued to correct a significant error introduced during the journal's editorial, typesetting, production, or publication process.

Such errors may include incorrect author affiliations, missing text, inaccurate tables, formatting problems, or other production-related mistakes that affect the integrity or interpretation of the publication.

B. Author Correction (Corrigendum)

A corrigendum is issued when an author identifies or acknowledges a significant error originating from the submitted manuscript.

Such errors may involve incorrect legal citations, inaccurate data presentation, analytical mistakes, incomplete information, or other matters requiring correction without invalidating the principal conclusions of the article.

C. Addendum

An addendum provides supplementary information, clarification, or additional explanation that is necessary to improve readers' understanding of the published research.

An addendum may address inconsistencies, clarify legal interpretations, or provide relevant supplementary information related to the original article.

An addendum must not be used to conceal fundamental errors or introduce substantial new findings that should instead be evaluated through a separate scholarly publication.

Correction Procedure

Requests for corrections may be submitted by authors, readers, editors, or other concerned parties.

The editorial team will assess the reported error and determine whether a correction is appropriate.

The handling editor may request clarification, documentary evidence, or a revised explanation from the authors.

Where necessary, the Editor-in-Chief may consult reviewers or Editorial Board members before reaching a decision.

The final decision concerning the necessity and type of correction rests with the journal's authorized editorial leadership.

Approved corrections will be published transparently and linked to the original article, with sufficient information to identify the corrected content and explain the nature of the amendment.

3. Article Removal

In exceptional circumstances, Yurisprudentia: Jurnal Hukum Ekonomi may remove the full text of a published article from its online platform when continued public accessibility would create serious legal, ethical, or safety concerns.

Article removal may be considered when:

  • The article contains defamatory or unlawful material.

  • The article infringes intellectual property rights or other legally protected rights.

  • The journal is required to remove the article pursuant to a valid court order or binding legal obligation.

  • The publication discloses highly sensitive, confidential, or protected information in a manner that creates serious risks to individuals or institutions.

  • The content poses a serious and demonstrable risk of harm that cannot be adequately addressed through correction or retraction.

Article removal will be considered only when less restrictive editorial measures are insufficient to resolve the identified concern.

Whenever legally and technically permissible, the journal will retain the article's bibliographic metadata, including the title, author information, publication details, and DOI.

The removed article's full text will be replaced with a publicly accessible notice explaining that the article has been removed and stating the reasons for removal to the extent legally appropriate.

The journal is committed to maintaining transparency while respecting applicable legal requirements, individual rights, and publication ethics.

4. Article Replacement

Yurisprudentia: Jurnal Hukum Ekonomi recognizes that, in rare circumstances, an article containing substantial errors may require replacement with a corrected and independently identifiable version.

Article replacement may be considered when the original publication contains serious inaccuracies that could lead readers, legal practitioners, policymakers, or researchers to rely on materially misleading legal interpretations or findings.

Replacement will not be used as a routine alternative to corrections or retractions.

When replacement is considered appropriate:

  1. The original article will undergo editorial evaluation to determine whether retraction is necessary.

  2. The authors may be invited to prepare a corrected version addressing the identified errors.

  3. The corrected manuscript will undergo appropriate editorial assessment and, where necessary, additional peer review.

  4. The original article will be clearly identified as retracted or superseded, as applicable.

  5. The replacement article will be published as a distinct version with appropriate bibliographic information.

  6. The retraction or replacement notice will include a clear explanation of the relationship between the original article and the corrected version.

  7. Links between the original article, its editorial notice, and the replacement version will be maintained to ensure transparency and traceability.

Where possible, the journal will preserve the publication history so that readers can understand the reasons for replacement and identify the authoritative corrected version.

5. Editorial Responsibility and Publication Integrity

Yurisprudentia: Jurnal Hukum Ekonomi is responsible for implementing retraction, correction, removal, and replacement procedures fairly, objectively, consistently, and transparently.

Editorial decisions will be based on the available evidence, the reliability of the scholarly record, relevant legal requirements, and established principles of publication ethics.

The journal will provide affected authors with an appropriate opportunity to respond to allegations or concerns before a final decision is made, except where urgent legal or safety considerations require immediate action.

Retractions, corrections, removals, and replacements will be documented through appropriate editorial notices and linked to the relevant published articles whenever possible.

The journal seeks to preserve the permanence, accessibility, and integrity of scholarly publications while ensuring that errors and ethical violations are addressed responsibly.

This policy is informed by the principles and recommendations of the Committee on Publication Ethics (COPE) concerning retractions, corrections, and the maintenance of the scholarly record.
